End User Agreement

You may use Adjustable only in compliance with this Agreement, applicable laws, and any policies or documentation we provide. You are responsible for your use of Adjustable and for activity that occurs under your account or within workspaces you manage.

Adjustable is intended for business use. You may not use the service if you are prohibited from doing so under applicable law or if your access has been suspended or terminated.

You are responsible for maintaining the confidentiality of your account credentials and for promptly notifying us of any unauthorized access or suspected security incident.

Workspace owners and administrators are responsible for managing workspace access, user roles, permissions, connected integrations, and the information added to their workspace. You are responsible for ensuring that users invited to a workspace are authorized to access the information available in that workspace.

You retain ownership of data submitted to Adjustable, including workspace data, financial data, accounting data, chart of accounts data, financial statement values, budgets, forecasts, financial models, assumptions, imports, reports, and integration data.

You grant Adjustable a limited right to host, process, transmit, display, analyze, and store customer data as necessary to provide, secure, support, and improve the service. This limited right does not transfer ownership of your customer data to Adjustable.

Adjustable provides software for financial reporting, modeling, forecasting, analytics, workflow management, and business operations. Adjustable does not provide legal, tax, investment, audit, accounting, valuation, or financial advisory services.

Reports, forecasts, calculations, dashboards, exports, and outputs generated by Adjustable are provided for informational and operational purposes. You are responsible for reviewing, validating, and approving all outputs before relying on them. You should consult qualified professionals where appropriate.

Adjustable may allow you to connect third-party services, such as accounting platforms, finance systems, banking tools, payment processors, or other business applications. By connecting an integration, you authorize Adjustable to access, process, and store information from that service as needed to provide the requested functionality.

You are responsible for ensuring that you have the authority to connect each third-party service and share the related data with Adjustable. Third-party services are governed by their own terms, policies, and availability.

You agree not to:

• Use Adjustable unlawfully, deceptively, or for fraudulent activity.
• Access, attempt to access, or use data, accounts, systems, or workspaces without authorization.
• Interfere with or disrupt the security, integrity, availability, or performance of Adjustable.
• Upload, transmit, or introduce malicious code, malware, harmful files, or illegal content.
• Reverse engineer, decompile, scrape, crawl, or attempt to extract source code or underlying models except where permitted by law.
• Misrepresent your identity, authority, affiliation, or relationship with another person or organization.
• Use Adjustable to violate the rights of others, including privacy, intellectual property, confidentiality, or contractual rights.
• Use Adjustable in a way that exceeds reasonable usage limits or places an unreasonable load on our systems.

Some features or workspaces may require a paid subscription. Paid plans, pricing, billing cycles, taxes, renewals, cancellations, trials, and usage limits may be governed by separate order forms, checkout terms, subscription settings, or billing terms presented to you.

Unless otherwise stated, fees are non-refundable except where required by law or expressly provided in a separate written agreement.

Adjustable and its software, design, features, workflows, interfaces, trademarks, documentation, and related technology are owned by Adjustable or its licensors. This Agreement does not grant you ownership of Adjustable or any intellectual property rights in the service.

Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable right to use Adjustable for your internal business purposes.

If you provide feedback, suggestions, ideas, or requests regarding Adjustable, you grant us the right to use that feedback without restriction or compensation. We may use feedback to improve the service, develop new features, or modify existing functionality.

You may receive access to non-public information through Adjustable, including workspace data, financial information, product information, or other confidential materials. You agree to use confidential information only as permitted and to protect it from unauthorized access or disclosure.

We may modify, improve, suspend, discontinue, or limit parts of Adjustable at any time. We may also update this Agreement from time to time. If we make material changes, we may provide notice through the application, by email, or by other appropriate means.

Your continued use of Adjustable after an updated Agreement becomes effective means you accept the revised Agreement.

We may suspend or terminate access to Adjustable if we believe you have violated this Agreement, created security or legal risk, failed to pay applicable fees, or used the service in a way that may harm Adjustable, our users, or third parties.

You may stop using Adjustable at any time. Workspace owners may request deletion of workspace data, subject to applicable legal, backup, security, and operational limitations.

Adjustable is provided “as is” and “as available.” To the fullest extent permitted by law, Adjustable disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

We do not guarantee that Adjustable will be uninterrupted, error-free, secure, or that outputs will be complete, accurate, or suitable for your specific business, tax, legal, accounting, audit, investment, or financing needs.

To the fullest extent permitted by law, Adjustable will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunities, or anticipated savings, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, Adjustable's total liability for any claim arising out of or relating to this Agreement or the service will not exceed the amounts paid by you to Adjustable for the service during the twelve months before the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

You agree to defend, indemnify, and hold harmless Adjustable and its officers, directors, employees, contractors, service providers, and affiliates from claims, damages, liabilities, losses, costs, and expenses arising from your use of Adjustable, your customer data, your violation of this Agreement, or your violation of applicable law or third-party rights.

This Agreement will be governed by the laws specified in any applicable order form or written agreement between you and Adjustable. If no governing law is specified, this Agreement will be governed by the laws of the jurisdiction where Adjustable is organized, without regard to conflict of law principles.
